TERMS OF SERVICE

By commissioning the artist any kind of way, you are agreeing to the terms and conditions below.These conditions are liable to be changed at the artist's discretion, with notice to any commissioners who have works currently in progress.i. Terms:
The Artist refers to winterslept/wintersleptart, or whatever her current alias may be.The commissioner refers to the client requesting the service.ii. General:
Commissioner agrees and confirms they are of an age appropriate by the laws of their region to commission the art they request.
The artist reserves the right to cancel the commission without reason if the artist suspects the commissioner is underage.Requests where no reference images are given, or where the artist is requested to design a character may incur an additional fee.The first three revisions are free, each revision after that will incur a 5 EUR fee.
The fee will be doubled for any revisions requested after coloring has been completed.Abusive behavior will not be tolerated and will result in the immediate cancellation of your commission.iii. Payment:
Payment is due as soon as the client receives, and approves of the initial rough sketch. The artist will not continue the piece until they have have received the payment.Payment is in USD and EUR only (EUR preferred), through Paypal, or through Ko-fi.Friends and Family is not an accepted payment format.iv. Cancellation and Refunds:
Once the work is completed, refunds are not permitted.
The commissioner may cancel the commission at any time before completion, after which the artist will refund an amount sans the value of the work already completed.Artist reserves the right to cancel the money for the commission at any time, if the artist cancels the commission the commissioner will receive a refund sans the value of the work already completed.Fraudulent chargebacks constitute a criminal offense in most regions. Any attempt to initiate a chargeback after work has been completed will be contested appropriately and reported to the commissioner's local authorities.v. Topics:
The artist refuses to create art depicting certain topics, these include but are not limited to; intense gore (candygore is permitted), any sort of hateful art (including, but not limited to anything LGBTQ+phobic, racist, ableist, xenophobic, or anything that targets and alienates a specific person, or group of people), pornographic or lewd art of underage characters ("aging up" said characters will be refused as well), scat, watersports, diapers, and bestiality.Commissioners requesting these topics will be refused.Revisions that suggest the commissioner is attempting to convert the art to feature one of these topics will result in an immediate cancellation.vi. Copyright:
The artist retains copyright ownership of all of the artist’s works, including the complete art that is being commissioned.All characters remain owned by their respective copyright holders.The artist retains the right to post, publish, and otherwise use the artwork as they see fit for their own use and promotion.The commissioner may print, post, and use the art as they see fit but holds no ownership of the art and must credit the artist, and may not claim it as their own work, nor use the artist's work in a way that is helpful to, is training or assisting any AI, neural networks and the similar.The commissioner may not edit the produced artwork, nor remove any watermarks or signatures.vii. Commercial use and Editing:
Art for commercial use will incur a 300% fee increase.Art not purchased in this way may not be used in any manner to make money, including but not limited to use in books, covers, merchandise and props.
